For Registered Users:

Platform for obtaining generic and preliminary information from HCP to a health related question: You may ask any health-related question on the Website and obtain preliminary and generic information to such question from a HCP. Your identity is not disclosed to the HCPs or other Registered Users at this stage.You can access the information supplied by an HCP to questions asked by other Registered Users on the Website.
ii. Platform for seeing general and preliminary information of HCP on questions submitted by other Registered Users.
iii. Platform to make an in-person appointment with an HCP: If the doctor is available, you may utilise the Website to make an in-person appointment with an HCP at the HCP's location.
iv. A platform for private contact with an HCP: You can have a private conversation with an HCP using the website's chat function or other communication tools after paying the HCP's consultation fee and, if applicable, a Panacea Ayur internet handling charge.
v. Platform to pay HCP for non-Website interaction: After paying Panacea Ayur's internet handling charge, you may use the Website only for the purpose of paying an HCP for a non-Website/offline engagement with that HCP.
For Users Who Are Not Registered:
HCP Profiles Access: You may view the HCPs' profile, which includes their name, qualification, experience, specialisation, consultant fees, personal statement, education, professional memberships, etc., depending on the level of information supplied by HCPs at the time of registering with the Website. The Website provides a number of search tools to help you find HCP profiles.
For Medical Professionals:
i. Platform to post profile: On the website, you may submit your profile, which should include your name, credentials, experience, area of expertise, consultation fees, personal statement, education, and professional affiliations. All registered and unregistered users have access to your profile.
ii. Private communication platform: You may use the website to communicate privately with registered users. During the private conversation, You may communicate using various tools given by Panacea Ayur, such as calls, and share messages, photographs, and videos using the platform's chat function.
iii.A platform for consulting fees for interactions of the website: You may use the website to get paid for interactions with registered users that take place offline or away from the website.
iv. Platform to answer health-related questions posted by registered users: You may answer health-related questions posted by registered users using Your general and preliminary information.

All Users (Registered, Non-Registered Users, and HCPs) May Use
You agree to use the website and its services solely in accordance with and as permitted by all relevant Indian laws. You won't use this website or any of its features for any activities that are prohibited by this Agreement.
You won't purposefully use the Website in any way that violates the law or causes harm to Panacea Ayur, its directors, employees, affiliates, distributors, partners, or service providers, as well as any Users, data, or website content.
You are aware that Panacea Ayur may send you SMS or Whatsapp messages on the registered cellphone number you provided at registration and while you are using the website. You can choose and book meetings with HCPS using the website. So, based on the details you give Panacea Ayur (such as area of specialisation and geographic location), Panacea Ayur can assist in providing You with lists and/or profile previews of HCPs who may be suitable to deliver the healthcare You are seeking.
Please be aware that Panacea Ayur (i) does not promote or suggest any HCPs listed on the Website, (ii) disclaims any representations or guarantees regarding HCPs or the calibre of any healthcare services they may offer, and (iii) does not assign ratings to doctors.
Before uploading or supplying any User Content, you shall obtain all necessary permissions and approvals.
You can use the website to make a reservation for your loved ones and friends. Please be aware, too, that any actions performed on behalf of his family and friends through his account fall exclusively under your responsibility.
You have the choice to post Your personal health information, such as your physical, physiological, and mental health status, as well as your medical records and history, on the Website, where the HCP may access it during private interactions with the Website.
For any private contact You have with an HCP over the Website, Panacea Ayur will charge an upfront internet handling fee.

Use by Non-Registered Users

Please be aware that Panacea Ayur (i) makes no recommendations or endorsements regarding any HCPs featured on the Website and (ii) disclaims any representations or guarantees regarding the calibre of any healthcare services that these HCPs may offer.
Refund Policy for Paid Consults
If a healthcare professional (HCP) is unavailable to respond to a paid consultation, you can notify Panacea Ayur of the problem and request a cancellation. Panacea Ayur will then process a refund for the full amount you actually paid, including any internet handling fees. However, Panacea Ayur's discount value will not be included in the refund.
Subject to Panacea Ayur conducting an inquiry, in the event it is established that an HCP violated any applicable laws, Panacea Ayur shall grant You a full refund.
If it is determined that you were abusive during the consultation, you will not be eligible for a refund, and Panacea Ayur/HCP will be free to pursue any appropriate legal remedies.
You have seven (7) days to notify us if any consultation was inadequate or unsatisfactory and ask for a refund. After that, refund requests won't be granted.
You can ask for a refund using the "Your Consult" chat window or by emailing care@panaceayur.com.
If Panacea Ayur determines that Your refund claim satisfies the aforementioned requirements, Panacea Ayur will process the refund in accordance with those findings, and the money will be repaid to You in three (3) working days after the day that Panacea Ayur has accepted the refund.
We guarantee to cure HSV/Herpes and HIV. If any patients don't get cured or show any improvement within a specified time then they will be asked to get admitted to our observation centre till we cure them or even if they don't show any improvement then we refund them in full. Please ask for form A by mailing at care@panaceayur.com.
PANACEA AYUR'S PART
Panacea Ayur's role is restricted to: a) offering a platform for hosting and publishing User Content, Lab Content, and HCP Content; b) offering a platform for Registered Users to ask questions about their health, and HCPs to respond informally and generally; c) offering a platform for private communication between Registered Users and HCPs; and d) offering a platform for finding HCPs based on Registered Users' inputs and HCP profiles made by HCPs themselves. enabling the payment of HCPs' consultation and service fees.
Panacea Ayur plays the role of a "intermediary" as that word is used under the Information Technology Act of 2000 and its implementing regulations. As a middleman, Panacea Ayur is not liable or responsible for any of the material or transactions on the website, including any HCP material or User Content, information given by HCPs or Labs, or interactions between HCPs and Labs and Users.
At any moment, Panacea Ayur is under no duty to pre-screen or keep an eye on HCP Content or User Content. However, if Panacea Ayur determines in its sole discretion that any User Content or HCP Content is in violation of this Agreement or any applicable law or industry standards, it may choose to monitor any User Content or HCP Content and remove any such User Content and/or HCP Content from the Website. In the event that Panacea Ayur removes any HCP Content or User Content from the Website, Panacea Ayur shall use commercially reasonable efforts to notify the HCP or User who originally uploaded the HCP Content or User Content, as applicable.Such actions do not in any way affect Panacea Ayur's role as a middleman or subject Panacea Ayur to any liability with regard to User Content and/or HCP Content.
Panacea Ayur maintains the right to contact the appropriate governmental or law enforcement authorities if it suspects any Registered Users or HCPs of engaging in any unlawful, improper, or fraudulent activities on the Website. This right is in addition to any other rights Panacea Ayur may have. Any investigation processes or demands for access or information made by these governmental or law enforcement bodies will be met with cooperation by Panacea Ayur.
Panacea Ayur does not support or exert influence over any specific medical theory, opinion, attitude, or stance on any issue.

User Content and HCP Content Rights

You agree to grant Panacea Ayur a perpetual, non-revocable, worldwide, royalty-free licence to use the User Content (if you are a registered user) or HCP Content (if you are an HCP), including the right to copy, distribute, display, reproduce, modify, adapt, and create derivative works of the User Content or HCP Content, as applicable.
PERSONAL INFORMATION

TERMINATION
Panacea Ayur reserves the right, in the event it finds out in its sole discretion that You breached the Agreement, to suspend and / or terminate Your user account and/or access to the Website by blocking Your IP address or email id with or without notice to You. Any suspected illegal, fraudulent or abusive activity may be grounds for suspending and / or terminating Your user account and/or Your access to the Website. Upon suspension or termination, Your right to use the features on the Website shall immediately cease and the Company reserves the right to remove or delete Your information that is available with the Company, including but not limited to login and account information.

MODIFICATIONS
Panacea Ayur reserves the right to modify any part of the Agreement at any time without giving You prior notice.
When We update the Agreement, the next time You visit the Website, the Website will provide a message to you (which may be sent by email if You have provided Your Email Id) which will intimate You of the amendments. You do not agree to the amendments, please do not use the Website any further.
ARBITRATION
Any dispute, claim or controversy arising out of or relating to this notice or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this Agreement to arbitrate, or to Your use of the Website or its features or the information to which it gives access, shall be determined by arbitration in India, The venue of such arbitration shall be Bangalore, India. The governing law of the Agreement shall be the substantive law of India. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the Parties .
The Parties shall have the right to apply to a court of competent jurisdiction to obtain interim injunctive relief in respect of any dispute, pending resolution of such dispute in accordance with the Agreement.
GENERAL PROVISIONS
Severability: If any provision of this Agreement is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision shall be excluded from the Agreement and the remainder of the Agreement shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms; provided however that, in such event, the Agreement shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal.
Notices: All notices and other communications required or permitted hereunder to be given to a Party shall be in writing, in the English language, and shall be sent by facsimile, e-mail, or mailed by prepaid internationally-recognized courier, or otherwise delivered by hand or by messenger, addressed to such Party's address as set forth below or at such other address as the Party shall have furnished to the other Party in writing in accordance with this provision:

Waiver: No term of the Agreement shall be deemed waived and no breach excused, unless such waiver or consent shall be in writing and signed by the Party claimed to have waived or consented. Any consent by any Party to, or waiver of a breach by the other, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
Complete Understanding: The Agreement contain the entire understanding of the Parties, and there are no other written or oral understandings or promises between the Parties with respect to the subject matter of the Agreement other than those contained or referenced in the Agreement.
Force Majeure: Panacea Ayur shall not be liable for any downtime or delay or unavailability of the Website caused by circumstances beyond Panacea Ayur's reasonable control, including without limitation, acts of God, acts of government, floods, fires, earthquakes, civil unrest, acts of terror, strikes or other labour problems, internet service provider failures or delays, or denial of service attacks.
Advice of Counsel: Each Party acknowledges: (a) having fully read the Agreement in its entirety; (b) having had full opportunity to study and review the Agreement.
Advertisement: Panacea Ayur shall have the right to place advertisements and publicity materials of its choice, including that pertaining to parties other than itself for commercial use through electronic means on the Website.
Assignment: You may not assign or sub-license, without the prior written consent of Panacea Ayur , the rights, duties or obligations under this Agreement, in whole or in part, to any person or entity.
Conflict: In the event there is any conflict between the terms set out in these Terms of Use, the Privacy Policy, the Additional Terms of Use for HCPs and any other policies applicable to specific pages of the Website, the following order of prevalence shall apply: (i) the Privacy Policy (ii) these Terms of Use, (iii) the Additional Terms of Use for HCPs and (iv) any other policies applicable to specific pages of the Website.
RETURN & REFUND POLICY
At Panaceayur.com, we do our best to ensure that our customers are immensely satisfied with our products. And we are happy to offer a complete refund in the following circumstances.
(a) You received a defective/damaged item(s).
(b) Delivered item(s) doesn't match your order.
(c) The ordered item(s) is/are lost or damaged during transit.
Following circumstances do not qualify for Return or Refund.
(a) Any wrong ordering of a product doesn’t qualify for a Return or refund.
(b) Return or refund requests arising due to a change in prescription do not qualify for Return.
(c) All products to be returned should always be in their original manufacturer's packaging i.e. with original tags, labels, bar-code and invoice.
(d) Used,Opened or Partially consumed products do not qualify for Return, only completely intact products can be returned.
(e) Return product should have the same batch number as mentioned on the invoice.
(f) Non delivery of product reported after 48 hours of delivery confirmation text message on registered mobile number.

Please Note: Mode of refund may vary from case to case. If the mode of refund is by Credit/Debit Card or Net Banking, allow 7 to 14 working days for the credit to appear in your account. If the mode of refund is by Wallet, credit should be available within 7 to 10 working days.
